permanent rule for stimulus funds
I'll take care of this. Note that we are still waiting to hear from EPA on the
critical issue of whether the prohibition on refinancing applies to the Coburg
situation. That will be a key issue in the permanent rule making given the
pending petition for rulemaking and threatened Court of Appeals challenges from
Coburg. LK

Subject: review of SRF permanent rule for stimulus funds
Larry K
We are now in the process of following up the temporary SRF Stimulus
rulemaking (adopted in April) with a permanent rulemaking. The tentative
schedule calls for review of the notice package in mid-June (6/19-25), public
comment in July and then a review of the EQC package in early September
(8/28-9/8) with EQC adoption hopefully in late October. We dont anticipate
much of any changes in the language.
You provided guidance with the temporary stimulus language, are you available
to review the permanent rule? I am just checking workloads and lining up DOJ
assistance with this rulemaking.
Let me know if you have the time/interest or whether I should check with Lynne
Perry or someone else at DOJ.
Thanks,
Larry M.
