We also appreciate Intel’s coordination and stewardship in conducting a comprehensive cleanup of chlorinated VOCs related to a waste solvent tank release at the Intel Aloha Campus (assigned ECSI No. 1131).

We have conferred with our Oregon Department of Justice representative and Cleanup Program management regarding your request for a solvent-specific No Further Action (NFA) determination. The counsel provided is that DEQ will be unable to provide a NFA determination once PFAS rules are in-place (in absence of data to support PFAS are not a contaminant of concern and do not pose unacceptable risk). We are also uncomfortable recommending a NFA and holding a public comment period at this time given that regulation of PFAS in Oregon may be effective as early as this September. In the event that rulemaking is significantly delayed, DEQ would be able to proceed with a NFA for cleanup of chlorinated VOCs; however, it will be noted during both public comment and decision documents that PFAS are a concern and were not addressed at the time of the NFA.

In conclusion, we believe that PFAS may have been released associated with the waste solvent event and recommend that you complete a reconnaissance-level sampling event in the historical solvent release area. If PFAS are not detected in Willamette Silt groundwater or are below relevant risk-based concentrations (EPA MCLs), we are comfortable proceeding with a NFA determination for the solvent release.

Internal review of the Staff Report is complete and thinking I can pick this back up next week to get the document ready for public comment.

A couple thoughts on next steps:

1) Did you want to review the Staff Report (for factual correctness only) before the document is finalized?

2) In terms of holding a public comment period seeking feedback on DEQ’s recommendation for a No Further Action, we typically start at the beginning of the month and for a duration of 30 days. In advance, DEQ prepares public notices (couple sentences to one-page) and these are posted in the local paper, Oregon Secretary State Bulletin, and the full notice on DEQ’s website. Given previous heightened public interest in everything Intel, there were periods during the project where we closely coordinated with Intel’s public affair specialists. It would be helpful to have a general understanding of the potential public interest at this time for preparation purposes, such as greater engagement with our public affairs specialist or preparing a communications plan, if needed. It would also be helpful to know if we would be overlapping with any other public comment periods related to Intel facilities in the area (e.g., DEQ permits). Let me know if we need to set up a time to discuss coordination on these matters and if there is a preferred timeframe for public comment. Potentially this could occur as early as April 1.

Stormwater within the LOF and immediately near it is directed to stormwater treatment system (designed for treatment of dissolved zinc and copper) before discharge to the municipal separate storm sewer system (MS4) that runs beneath SW 198th Avenue, near the F4 Pond 1 (see Attachment 2). Most stormwater in the LOF, including roof runoff, runs off from the F5 Basin into Intel’s subsurface storm sewer system, before being pumped from a lift station in the southeast parking lot to a stormwater treatment system immediately south of the F4 Pond 1. Following treatment, the stormwater is discharged to the MS4 before ultimately reaching an unnamed stream east of the site. In the event of runoff exceeding the design flowrate of the lift station, or loss of operation of the lift station, runoff from the F5 basin will discharge through an overflow pipe into a lined detention pond (F5 Pond) in the southeastern part of the LOF (the pond is lined for emergency spill containment and includes an electronically operated control valve). The water in the F5 Pond drains via piping to the unnamed stream east of the site. Stormwater discharge from the entire Intel property is managed under a National Pollutant and Discharge Elimination System (NPDES) 1200-Z permit. Stormwater runoff in the northeastern part of the site is directed to unlined detention ponds in the northern of the site (F4 Pond 2 and F4 Pond 1, see Attachment 2). Stormwater runoff within a small area in the southwestern corner of the LOF is directed to the South Lot Pond (see Attachment 2). Stormwater runoff within a small area of the parking lot in the southeast corner of the LOE is directed into the F5 Pond and not the aforementioned stormwater treatment system.
