Subject: Voluntary Agreement between Townsend farms, Inc and DEQ

Dear Mike and Margaret-

As you know, we met on site at your Fairview property last fall to discuss the status of the  remedial investigation (RI) conducted by Townsend farms, Inc, under the terms of the 2007 voluntary agreement you have with DEQs Cleanup Program.   I subsequently mailed a letter dated October 19^th, 2009 summarizing the status of the project, and approved the RI report that GeoDesign, Inc completed on your behalf.  Additionally, the next steps to complete a no further action determination (NFA) for the site were presented in that letter.   Under Section IIH of the voluntary agreement, quarterly progress reports are stipulated.  The last progress report I have is dated June, 2009.

Having received no progress reports since that time, I assume that the agreement is no longer a priority for Townsend Farms, Inc.   Accordingly, I will maintain the project files for a period of time before archiving. If I am incorrect in this assumption, or if Townsend Farms, Inc. chooses to continue work on the project at some point this year, let me know, and we can resume work.
