Dear Mr. Zimmerli:

 

Thank you for your prompt response to the Oregon Department of Environmental Quality (DEQ) request for performance of a remedial investigation (RI) at the McCall/Great Western facility located at 5480, 5540, 5700 NW Front Avenue in Portland, Oregon. Based on your willingness to proceed, DEQ has enclosed a copy of the Remedial Investigation Agreement and Scope of Work prepared for the McCall/Great Western facility.

 

As described in the Strategy Recommendation for the McCall/Great Western dated November 15, 1999, DEQ determined that remedial action might be necessary to protect public health, safety, welfare and the environment. In a letter dated November 19, 1999, DEQ requested that McCall/Great Western conduct a remedial investigation and feasibility study in accordance with the Environmental Cleanup Law, Oregon Revised Statutes (ORS) 465.200 et seq.

 

DEQ proposes that your performance of the remedial investigation be governed by the enclosed Voluntary Agreement for a Remedial Investigation (Agreement) and Scope of Work (SOW). The facility’s remedial investigation will be coordinated with the Portland Harbor Remedial Investigation and Feasibility Study currently being pursued by DEQ. This will require commencement of the remedial investigation at the McCall/Great Western facility in the near future.

 

Please review the enclosed Agreement and SOW. It is DEQ’s expectation that the enclosed Agreement be signed by March 31, 2000. Consequently, DEQ requests that any questions regarding the enclosed Agreement and SOW be resolved no later than 15 calendar days from the mailing of this letter. However, be advised that DEQ does not intend to substantially negotiate or revise the terms of this standard Agreement.

 

DEQ is required by Oregon Revised Statue 465.330 to recover remedial action costs incurred by DEQ. DEQ has incurred costs for Site Assessment activities including preparation of the Strategy Recommendation and draft Agreement. As of January 31, 2000, DEQ had incurred costs of approximately $11,045.61. You will be receiving an invoice for these costs in the near future.
