Did this get answered last week? I agree with you Jennifer that if the release was associated with the tank system (dispensing system) then it would be a new release and a LUST. I don’t think we allow a small amount of contamination w/o reporting as a LUST I don’t think we would do an admin closure, but a relatively quick (no staff memo) closure, with CRA, etc. Is this what you all thought? The forest service poses a question regarding their sampling results. They show no contamination found around tanks; only a small amount below RBCs by the pump/sump area. They subsequently removed 1.5yd of soil. They are asking if this would qualify for a LUST admin closure since the contamination did not occur at the tanks. I’m wondering your thoughts on this; is there a small amount of contamination allowed without reporting? If it is from pump/sump area would it still be considered a LUST site, or does that qualify it as an ECSI instead? I would think that since the release is associated with tank apparatus, we would still consider it a LUST release. However, I’m wondering about the NFA requirement for this type of release. I believe the leak report was made erroneously, possibly by a contractor. The UST Decommissioning Report, supported by field observations, photographs and sampling results, documents that no leak occurred from the tanks. Typical dripping around one of the pumps resulted in minor contamination (one area slightly above Minimum Reporting Limits but below Risk Based Concentrations) and 1.5 cy of soil was removed. I’m not suggesting we side-step your delisting process, rather inquiring if there is an alternate path to preclude unnecessary staff time. Perhaps a phone call would be best? Many Thanks!
