Dear Representative Lewis,

Below is an email I just sent to Region 1. I believe the intersection of Hwy 213/Toliver Road is one of the top 10 worst intersections in Region 1 if not the state for injury accidents. The last time speeds were set in this area was back in 1976 and 1995. The population in 1990 was 3,637 and in 2017 was estimated at 9,610. Attached is a copy of the Resolution recently passed by the City Council in support of the speed reduction. I wanted to make you aware of the issue we have here and the steps we are taking to reduce the number and/or severity of crashes in our community. A significant amount of federal and state money has been spent on OR 213 north of Molalla and I believe it is time that funding by state and federal resources are directed to Molalla to address these safety issues. I’ve also attached a copy of the draft Road Safety Audit.

It is important to note that Hwy 213 has a daily north-south traffic count of 12,500 vehicles per day. A recent traffic study showed the following counts with estimates in 2038:

According to my calculations the City’s traffic contribution to and from the east leg of the intersection is 215 (2017 AM Peak), 296 (2017 PM Peak), 345 (2038 AM Peak), and 500 (2038 PM Peak). Of the total trips, that equals 27% (2017 AM Peak), 24% (2017 PM Peak), 26% (2038 AM Peak), and 25% (2038 PM Peak). Assuming a future impact of 26% by the City, I believe that the State’s contribution should be 74% since its thru traffic constitutes that percentage through this intersection. Unfortunately, the way the Transportation Planning Rule is written and the State’s interpretation of that rule, the costs are dumped on to new development and/or local communities to address deficiencies on the state highway system. ODOT has secured funding totaling $700,000 for design of a roundabout at this location but no funding is set aside for construction of what will likely be a $3.5M construction project. Using these numbers, the City should contribute $1,050,000 and the state should contribute $3,150,000 or $2,450,000 towards construction once you take out the $700K they’ve secured for design. That is a fair contribution by both parties.

I will send you a future email citing the TPR language and how I think it is flawed and burdensome on small communities. Thanks for your time and let me know if you have any questions.

Subject: November 1st accident on Hwy 213

Hi Elizabeth,

On the evening of November 1st at around 5PM there was a 3 car injury accident at the intersection of Hwy 213 and Toliver Road. The accident involved a southbound rear end that pushed one car to the west side of the road and the rear ending vehicle drifted east into oncoming traffic. The accident was covered by OSP and the City Manager has just received the information regarding the accident. I have received support letters from everyone but the Fire Department and will be sending in a speed reduction request by tomorrow. Once I receive the support letter from the Fire Department then I will send it on.

This intersection is quickly becoming one where we can anticipate a death if we don’t slow down folks and get the needed intersection improvements completed at Toliver. I will scan and send you a copy of the speed reduction request. Anything that Region 1 can do to support the reduction, institute an interim speed reduction, and/or apply for federal funding toward construction is greatly appreciated. I’m sure that we can get Council’s support to be a co-applicant for federal construction funds. Thanks.
