Mr. McLean,

Attached is the Pre-Enforcement Notice related to the inspection I performed at your facility on November 15. 2023. On the phone yesterday, you told me that you are contesting the field citation that I issued after that inspection. Referring these violations to formal enforcement is the next step in that process.

I want to make sure that you understand that the civil penalties for these violations in the formal enforcement process will be substantially greater than the $950 total for the field citation, and that you will be responsible for paying the civil penalties should a hearing not go in your favor. And again, the violations of Oregon Administrative Rules cited in this Notice reflect the conditions at the facility at the time the inspection began, not after any corrective actions that you may perform.

After I submit the referral to our Office of Compliance Enforcement, you will receive a Notice of Civil Penalty and Order, after which you can submit a written request for a hearing.
