Hi Kerry, Jennifer asked me to review the information you provided to DEQ about the Shady Cove site. Attached is your memo summary, with several comments/questions I have. Some key things I need more information about are listed below. Sorry if I should know some of this.

1. Is this a UST decommissioning? I assume so if you were able to observe the condition of the tanks.
2. Were these tanks installed in 1988? What is their history?
3. Which tanks contained what?
4. On the figure, what are the gray boxes with “+” in them (see figure below), and the black boxes next to them?
5. I’ll need more information about the locations of the 1988 samples to compare with where you sampled.
6. I will need a table or tables with data and sample numbers that correlate with a map. Like your Figure, but with the 1988 sample locations, and data summarized. Or separate tables and figure(s).
7. I will need to know more about the tank pit and line testing you did recently. What exactly does this involve?
8. It should be noted that 35 years is a long time for an older tank system to be in operation without leaks.
9. If I get more information, I may be able to make a call pretty quick, without the need for a cost recovery agreement. I will need to see the additional information. Please work with the LUST Duty Officer on when this information needs to be provided. If it is not provided by then, a new LUST should be opened, and if determined later to be the old release, could be administratively closed.

Christy has provided additional lab results for this site. As requested below, we are needing to see your current decommissioning report which includes a sample map. Additionally, if you wish for this release to be treated as attributed to the prior release in 1988, a comparison report will need to be submitted that will justify your findings. Thank you for reaching out. It is my understanding that the line removal is wrapping up this week with the balance of the samples being taken.

I do believe some lab results are available from the tank area although I assume they are waiting to get all the labs done before issuing a report.

Kerry & Tim – if you wish to have DEQ concurrence that this release is actually contamination from the original release from ’88 (LUST#15-88-0025) then we will need to know more information about the current conditions at the site including the decommissioning report and lab data, which includes a map of sampling locations. To make a comparison to the prior release, we will also need to know what final sampling data looked like at the time of NFA. Please let me know your timeline for providing this information.

If we do not receive this data, we will need to go ahead and process the new release for this site.
