Hi Derek,

 

The options allowed under our requirements are to bore or the street cut as described in our moratorium street cut requirements. New aerial crossings are no longer allowed and the one installed must be removed. If you cannot perform the bore or street cut options in order to serve your client then that is a business decision that Wave will need to make. It is unfortunate you don’t already have service on that side of the street to allow for a drop off of an existing pole at the property and the costs to go underground are to prohibitive to Wave to provide service to a customer. Notify Sam when the service has been removed by next Friday or if Wave has reconsidered the underground alternative. Thank you.

Yes after several attempts to get this resolved it has came down to this.

 

We can leave the Aerial drop as is and continue to service the US Bank

 

Or we can inform the Bank to get a differant provider and disconnect the service.

 

Please let us know what you want us to do and we can inform the Bank of the disconnect time frame if needed.

 

The road bore will be over 10k to get done as it will require a street cut with high pressure gas / water / Sewer / Fiber ducts etc.

 

The attempt to get this done was broken off due to the amount of potholes and the amount of rock and cobble that made this bore impossible.

 

This was originally a mainline request but once I was notified that our footage was under a drop length I changed it to a standard service drop.

 

I was under the impression that service drops were still allowed to go aerial in town but since you provided this documentation now we will be un able to get this underground.

 

This leaves us with the two options. We understand your position and if you want us to notify the Bank please let me know what time frame you want this taken down or left as is.

Following up on Permit PW34-2019

 

Its been over two months and have not heard or seen anything come back on correcting the violation. The last email I received form you was back on October 28, 2019 stating that you were going to find a solution and keep me informed. I have been advised by the Public Work Director that the violation needs to be resolved by next Friday January 24, 2020. Please inform us on what action will be put in place to make sure this gets resolved. If not taken care of, actions will be put into place and possible pulling the Utility Franchises Permit for the City of Molalla. Please reach out to me asap.

In 2017, the City formally changed its public works standards in line with the development code and required all new franchise utility crossings of the roadway to be underground via boring or by trench crossing. We have specific requirement for repairs of the roadway and in the case of moratorium streets a grind and inlay requirement. The grind an inlay for streets with pavement 4” or less requires a t-cut followed by an offset grind an inlay. For streets over 4” there is additional offset grind and inlay requirements for each 2 inches of pavement. A 6” section would require a 1 foot T-cut, 1-foot grind and inlay out to 2 feet, 1-foot grind and inlay out to 3 feet. Heintz is a moratorium street.

This is pulled straight out of our “Molalla Standards Specifications for Public Works. You also can find a copy on our web-site. Please follow the approved Permit that was issued. If you want to make any changes to the original permit, you will need to submit for review and approval. Please let me know if you have any question.

 

 

2.2.34 Utilities

 

The following specifies the minimum requirements for utilities:

 

a. Franchised utilities shall be located underground, outside the paved road if possible, to avoid future cuts in pavement.

 

b. A Public Utility Easement (PUE) shall be required adjacent to right-of-ways on all frontages to public roadways; PUE widths shall be as provided in conformance with Subsection 1.17.14, “Easements,” and the City’s detail drawings. PUE’s shall be graded as per Subsection 2.2.27, “Curbs and Grading Outside of Street,” from back of curb or sidewalk unless otherwise approved by the City’s authorized representative. Earthen berms or any other encroachments are not allowed within a PUE.

 

c. On all phased (interim) road improvements, the necessary utilities shall be stubbed across the interim improvement to assure that cuts are not necessary when the road is expanded to its full width. A 5-year moratorium will prohibit street cuts on all projects. The moratorium begins when a project is complete and the warranty begins. Check with the Public Works Department for a current list of streets on the 5-year moratorium.

 

d. Except for sanitary sewers, storm sewers and water mains, underground utilities intended to provide direct service to adjacent properties with future connections shall not be located in the full-width paved section of a street to be constructed.

 

e. Underground utilities that must cross an existing paved street shall not be installed by any method that cuts the pavement, unless approved by the City’s authorized representative.

 

f. Underground utilities shall be buried a minimum depth of 36 inches, measured from finished grade to top of utility.
