Chad and Dan,

Sent you a meeting notice that Wave will need to respond in writing by May 1st. If they do not or their response is not satisfactory to ensure compliance with the franchise agreement, then I think we can proceed with the 60 day clock from April 10 to June 09 and recommend to the City Council anytime after that to terminate the agreement under Section 18 of the franchise agreement. Dan,

Attached is a copy of the letter that went certified to both locations today and I’ve provided you with a copy of the current franchise agreement. Once they accept the certified letter, they have 15 business days to respond in writing. Once I receive it I will get you a copy. Hopefully they will understand our resolve that they follow the rules so we don’t have to go to the next step. Per discussion with Sam, their project manager stated they don’t always take out a permit when they should. The two instances in the letter of no permits are the documented cases we know about.
