Hi there. My husband and I at 580 Carter Lane are planning to build a fence to line the driveway and along the north side yard and have a few questions.

When I first purchased the house in 2010 I asked staff from the City of Molalla to come to make some fencing recommendations. I'm not sure of the names of the employees that came out (I have a card around here somewhere!) but they told me that my west to east fence that meets the private lane is outside of code. My property is one of two flag lots on Carter Lane, and the residents at 560 Carter Lane and I both have lengths of private driveway (Carter Lane) that meet the street at Toliver Road. I was told that the east end of the fence that runs west to east that meets Carter Lane should be at a lower height twenty feet back so as not to obscure the view entering Carter Lane.

I have been unable to locate this in code research. It is possible that they were viewing Carter Lane as a city street and not a private driveway, thus the recommendation for the lower fence, but Carter Lane is a private driveway.

 

I just need to know what the code actually is so we can modify the fence height if needed and keep the code in mind when replacing the fence.

I plan to also fence the line of the private drive that borders 806 Toliver Road and need to know the process for getting permits for this. Also, we will need to have someone come out to determine the exact property line for the project(s). This may already be on file from when Carter Lane was asphalted and the existing fence on the north edge was built but we need to know for certain before we start.
