Gerald and Brenda,
Stu passed this along to myself and Gary Wargnier.
To my knowledge, MCC has obtained permits for right of way construction in
the past when required by the City. I can’t attest to everything that’s
been done in the past, how records have been kept, when permits were
required, etc., but I can say that when permits were required either MCC or
our contractors have obtained permits.
I think it would be a good idea to get together to discuss expectations on
permits, MCC’s facilities related to City ROW and the process related to
possible damage to City facilities.
Do you have any time this week? Maybe Wednesday or Thursday?

Stu,
Last week we found another damaged sewer line which had been bored thru by
MCC as the most likely culprit. I took a look at our right of way permit
log and noticed that MCC hasn’t been pulling right of way permits. Can you
please pass on the fact that your company needs to pull a right of way
permit for any work done in the public right of way – including boring.
This is based on the language in the franchise agreement between MCC and the
City. You can check with Gerald for clarification.
