Good afternoon,

Here’s today’s update! Please keep letting us know how we can assist you, and if there are any particular topics or questions you’d like to be addressed.

CARES Act funding as Match for PA: There has been some reporting that the CARES act funding can be used to match FEMA cost share requirements. We are aware of this, but don’t have any official guidance from Treasury or authorizing legislation that would support it at this time. HQ is working with Treasury on this and hopefully we will be able to provide further clarification soon, and will update accordingly.

Eligibility of PPE: FEMA has been receiving questions regarding the purchase of PPE and distribution of such materials. Our response is that SLTT Applicants can purchase PPE and distribute it to public and private medical care facilities and emergency service providers (ambulance, fire and police) and be reimbursed by PA at the prevailing cost share. However, an eligible Applicant could not procure PPE on behalf of a private business and be reimbursed by PA. FEMA and HHS are working together to distribute cloth facial coverings as part of a multi-prong approach to re-open American economic activity while continuing to limit spread of COVID-19 through direct federal assistance. Only eligible PNP medical care facilities treating COVID-19 patients would be eligible for the reimbursement of PPE directly. Purchase of PPE is only eligible as an emergency protective measure. For PNPs, emergency protective measures are generally limited to activities to prevent damage to its eligible facility. This is because emergency services are usually the legal responsibility of SLTT governments. In limited circumstances, FEMA may reimburse a PNP directly when essential components of a facility are urgently needed to save lives or protect health and safety, such as an emergency room of a PNP hospital. See PAPPG V3.1, Chapter 2:VI.B. For COVID-19 declarations, eligible PNP medical care facilities providing treatment to COVID-19 patients would be eligible to request reimbursement for medical care services including the purchase of PPE. Any other PNP facility would not be eligible under PA for PPE. For further clarification on this question please contact your PA lead or FEMA-R10-PA-Policy-COVID19@fema.dhs.gov.

Real Property, Durable Equipment, and Temporary Leases: Many jurisdictions are incurring costs for property and equipment that may require reconciliation on the back end. Applicants should discuss purchases of real property, equipment with a value of over $5,000 and a useful life of over one year, and leases of temporary facilities with their appropriate state POCs. All of these have specific requirements that come into effect as soon as their authorized purpose concludes, which, at this time, will be no later than the end of the federal Public Health Emergency. At this time, there have been no COVID specific changes and the standard guidance continues to apply: disposition of real property will be coordinated with FEMA Headquarters, the salvage value of equipment will be deducted from the eligible total costs of the project worksheet it’s on, and FEMA will not pay for leases beyond the end of the PHE, when they should terminate for convenience. For some specific projects different guidelines may apply. Please advise your applicants to exercise prudence when engaged in the purchase or improvement of real property, the purchase of equipment, or the leasing of temporary space.
