In response to your first question, the City is upgrading all the ADA ramps to current ADA standards within the project limits. I am not aware of any requirement for documenting any noncompliance ADA ramp as a condition beyond the project limits being undertaken, can you provide us with a reference?
The attached signed plans were sent to you via e-mail addressed to Mike Keyes at ODOT (this morning) for permitting the work on Grange and Hwy 211 intersection. Sheet C8 calls out the tactical warning as yellow color and refers to ODOT RD 756, option B for construction. As far as the Black vs. Yellow on the City streets, I will defer the answer to Jennifer for why the City has chosen the Black color.
We would prefer not to delay this project and are proceeding with the advertisement and soliciting bids on this project, if any changes are needed, they can be addressed by an addendum or a change order.

Thanks for the information. These are the answers I needed to hear.
Is someone writing letters or a memos to your project file on the areas the city is not choosing to update? Now, for ODOT to reimburse any State funded project we need to know and concur that sufficient documentation is in place.
Please note – ODOT by specification uses Safety Yellow for our tactical warnings in ODOT R/W. However, if the city maintains outside of curb we can allow for the black color (I’m not sure what agreement is in place without contacting the district) as long as the product is on the QPL. I have sent an email to the district to see if they want to include a permit, or if they are comfortable with Local Agency oversight. Is the cities intent to request Black Truncated Domes for ramps for all of OR211?
I plan on giving Hassan a call, I will need a updated plan set to review and discuss with the district. I will likely need to see a copy of the documentation discussed above and the stamped plans prior to the city bid.
Now to answer your question. Up until this year most 1R pavement projects were exempt from ADA ramp improvements. With FHWA’s clarification on what is considered maintenance that is no longer the case. Current and new projects will capture the ADA ramps in them – there are special cases that may be stand alone. USDJ and FHWA did not issue their Technical letter until July of 2013, if I remember correctly ODOT projects bid after that date were looked at to add ramps. – If that area was done by ODOT maintenance staff they were likely not made aware of the letter until after FHWA’s meeting in August.
Likely the paving you are talking about fell before the clarification and/or letter. That being said, ODOT does have a bucket of funds to replace missing or non-compliant ramps. These funds are mostly distributed on the State side of the building, not the Local Agency. To inquire about getting those funds or replacement of those ramps you should contact the Area Manager Rich Watanabe. Since Basil is part is the cc’s on these emails he is now aware of the area. I would also suggest making a standalone email to Basil about bringing ramps up to date within the city if funding and or grants become available.
I would also watch this website http://www.oregon.gov/ODOT/TD/AT/pages/index.aspx if you don’t already. They post when new programs and grants provided by ODOT are available for application and funding. Apply for everything the City is eligible for.

Thank you for the web links, they will be useful for research when in question.
I do want to let your know my background for the last 10 years has been with WSDOT, where I participated in implementing the 2010 ADA standard changes and policy within the SW Region about 5 years ago. I gained additional experience by enforcing ADA standards in regards to developer review process, along with design and construction inspection for various cities in the SW Region.
I have reviewed, measured and verified slopes the existing ADA ramps in the field for the Stowers, Grange and Heintz Roadway Improvement project. Any non-conforming ramps have been noted and will be retrofitted within the project.
In regards to your comments in the previous email:
· We are choosing to go with black truncated domes for any new ADA ramps or where needed. This will technically meet the dark on light 2010 ADA Standards requirement. I am not aware of any ramps with in the project limits that are not contrasting in color, however there are a few that will be clean or replaced if damaged.
· In reference to providing two (2) ramps when possible. Are you referring to the connecting ramps on the south side of Main St/211 at Grange. If so, we have chosen to not upgrade those ramps at this time for several reasons; there currently are existing functioning ramps, we are minimizing construction costs to make upgrades elsewhere where ADA ramp issues are critical and this project is not making improvements on Main St/211 at this time.
· As for sidewalks, the City is meeting the ADA minimum guidelines and recommendations of 60” or 5 feet width. In general, for commercial areas 6-ft minimum width is required by the City for any new sidewalks where available or feasible, and 8-ft widths for special identified high use routes such as Main St and Molalla Ave. For the Grange and Main St/211 intersection, we are reconstructing 6-ft sidewalks on the west side of grange where feasible. All residential streets will be constructed to the City 5-foot minimum requirement.
I do have one question regarding ADA ramps along state highways. When a grind and inlay or overlay project is completed, does the state upgrade ADA Ramps at that time as required? Or is this handled out of a deferred ADA budget? Last year paving was completed on Main St/211 for a short section through the middle of Molalla and no ramps were modified for ADA standards. When do you anticipate the state to upgrade these ramps?

Hey guys,
I wanted to provide you a good amount of information on ADA. One of the links (with **) is a Class by FHWA and Fed Civil Rights that explains many of the comments I gave. I have shared this with Curran-McLeod previously when they were designing projects in Canby. I intend on calling Hassan and talking with him. I will also be going out to Sandy Thursday and could come out your way with our ADA coordinator and look at the ramps with both the city and consultant.
Now there are ways around not following ADA but it requires a design exception for each location. The city will need to be comfortable with each design exception because if any instance ever happens at one of the locations the city will be held accountable. Also if an Advocate is in your area, they can file a claim for non-compliance.
As always, when time and funding allows our project services unit can/will provide assistance to the city on your projects – especially with ADA designs.

That is correct, but
Stowers Rd.’s domes are not contrasting. Even a couple on Heintz – Is someone painting them?
Without a field visit or better pictures I’m not sure Stowers Rd. existing ramps meet current standards. Someone needs to check grade and landing size.
The existing ramps that are labeled “retrofitted” – can’t be retrofitted they need to be removed and replaced (Mostly all occur Grange Ave).
The Cities details sheet does not meet all current ADA guidance – ODOT pull sheets will be required for OR211 connection. – Please note current ADA guidance requires 2 ramps wherever possible (one is allowed but it needs to be justified). If city is not providing a minimum sidewalk width how are you making sure you have a 4x4 landing and the 2 feet of domes – from the drawings 6 foot sidewalk should be the minimum but project is building 4-5, thus making the majority of the ADA ramps non-compliant.
I sent this out so I could beat the solicitation of the project. It is a lot cheaper to fix this now than after the contractor is gone and the city is asking for inspection and payment.
These are likely easy fixes, unless R/W is an issue. I also don’t know the hydrology of the area to know if step-down ramps can be use in a lot of these locations.
