I remember the 4 sec-ft in Trout Creek, now that you mention it. The City was not supposed to withdraw more from the Molalla River than the earlier right on Trout Creek. And, measuring the flow from Trout Creek was a key element in determining the allowable withdrawal rate.

Sounds like we can work out the details and make it work.

The monitoring station was supposed to be installed at the old point of diversion at Trout Creek verifying the 4 cu ft per sec. There is a structure crossing the creek that a flow meter could be connected to, however the location is remote and data would needed to be transmitted manually. Here is a rough location of the Trout Creek tributary to the Molalla River.

No problem, Jennifer. Your concerns are valid and we should act soon.

My only concern is item 4; monitoring the river near the old point of diversion. I don't know if this monitoring station was a part of the original construction, but it should have been. Or, is there a structure in-stream that allows the river flow to be estimated?

I will check in with you later this week and we can go over the details.

Hi Pat,

I recently spoke with Hassan concerning our water rights situation on the Molalla River and he referred me to you. We currently have a pump station located on the Molalla River as shown in the attached map. In 1999, the “point of diversion” was transferred from a location on Trout Creek (original Cert attached) to the Molalla River location shown on the map and described in the document, also attached. This proposal was contingent on a list of conditions in the document, however the conditions to transfer the rights was never followed through on and no new Certificate has been issued. Primarily due to not meeting conditions number 3, 4 & 5, regarding installing and operating a measuring device for measuring and recording the quantity of water. The provisions also indicate the proposed change shall be completed on or before Oct. 1, 2004, approximately 10 years ago.

I am uncertain of the next step to move forward with amending this “change to the Point of Diversion” document and installing an in-line flow meter or other device. Is this something you are able to help with?
