Well of course it’s against city code:
13.08.240 Unsanitary deposit of waste.
It is unlawful for any person to place, deposit, or permit to be deposited in any unsanitary manner on public or private property within the City, or in any area under the jurisdiction of the City, any human or animal excrement, garbage, or other objectionable waste. (Ord. 2007-07 §1; Ord. 1976-2 Art. 2 §l)
But enforcement is impossible, it’s really about education and people respecting public space.
I hope the improvement of the ROW will deter future infractions with more eyes on the street.

We are beginning construction next week and no one can walk down the trail after that. I will be closed to pedestrian traffic during construction. Afterwards, there will be sidewalks so hopefully people will clean up their poop on a sidewalk.
I don’t think DEQ will do much of anything since it is our responsibility. Does are code support enforcement of this? Can a person be cited?

Perhaps we could get some of those ‘Pick Up After Your Pet’ signs from DEQ or something? I realize with the Heintz project starting soon it should alleviate some of the privacy this trail affords, which should help deter people from leaving pet waste.
Do you have a contact at DEQ I could talk to?
