Hi Rod,

This was in the paper a few months back, the new county ordinance goes into effect beginning January 8th. Mike was calling just to inform us the county will not be enforcing the new code within any city limits to remove confusion.

We currently have code regarding barking dogs under our noise ordinance. Code Enforcement typically sends a letter to dog owner first as a common courtesy. If we need to enforce a repeated annoyance complaint, our code permits us to fine the owner under the noise ordinance. We could update our code to include all noise disturbance sounds and identified in the county code attached above.

My only concern is do City residents have to pay the $6 increased fee if the county is not enforcing it in the City limits???

Jen,

Did whomever this was leave a message with specifics about what changes he might be talking about? I would like to see what they have going into effect. Aside from whatever the County’s changes that might be coming to them, you are right that our local ordinance allows us to enforce those types of complaints under our noise ordinance as it currently stands. I can’t find the reference to any County changes to compare, but we can take a look at it to see if the changes would be helpful to adopt, or not. Until then, we can proceed with business as usual and enforce what we have. These barking dog type complaints do happen, but they are not that frequent and people usually comply once we make contact.

His message states they will not be enforcing the rule within City Limits. I believe our code currently allows for us to enforce noise complaints.

See 9.13.030(L)(10) Specifically

L. Unreasonable Noise. Sound or noise which because of its loudness, frequency or duration could reasonably be expected to cause annoyance or alarm to another person, including, but not limited to, the following:

10. Animals. Permitting any animal to cause unreasonable annoyance, alarm or noise disturbance at any time of the day or night by repeated barking, whining, screeching, howling, braying or other like sounds which may be heard beyond the boundary of the keeper’s property, except when the animal is being provoked or protecting property from trespassers.

We are covered to enforce it ourselves.

But does that law apply inside the city limits of Molalla? If so is there an enforcement plan? Did the County check with local government?
