Hi Rory,

The toxins will not reach the storm or sewer system theoretically. Toxins would have to be directly poured into the system itself to be considered illegal. The main concern here is that the toxins do not reach a ground water source. This typically takes a long time.

The only teeth we may have in this situating is if we have a City Code that enforce toxins leaching into the ground or if we have a City Code that restricts smells (which I highly doubt for a residential district). If we do not have a code that prohibits property owners from allowing toxins to leach into the ground I would suggest sending him a letter requesting him to line the soil with a protective barrier prior to setting his railroad ties. However I need to review our TMDL first. This may have some DEQ requirements regarding toxins on private property, but I will need additional time to investigate.

Also, we will need to note how close the ties are to a water source, creek, drainage ditch, river, ect.

Jen,

Question of the day… I believe I spoke with you about this lady’s message last week. I don’t think there is much we can do about these railroad ties as far as City Code goes. The only thing that really comes to mind has to deal with discharging toxins into the sewage drains(13.08.500), but then it comes down to, how do you prove that they are toxic in the first place?? Would that be DEQ? The railroad ties divide their property lines and don’t look bad or anything. She claims that she can smell them but I can’t smell anything. I don’t think there is much that I can do, but I just wanted to get your opinion on the matter before I give a response. Thanks
