Hi Jeff,

You may have already caught this, but just in case I wanted to let you know I looked up the OAR Tiffany cited in her emailed letter. It does not match the official OAR wording beyond the first sentence. I wouldn’t think that it is not legal to misrepresent state law??

Also as Dan hinted to yesterday, I cannot find anywhere in the permit in regards to the Leak Test that we are required to complete the test in compliance with any state OAR. The rest of the Schedule D requirements either call out an OAR to comply with or references another Section with specifications.

I can understand if we need to take further actions as the permit states, but to slap us with a Warning and threat of a Class II violation is over the top.

Jeff- one thing that I believe is clear is that our permit does not refer to an ORS that we would be specifically violating. DEQ is using a generic ORS to send us the letter. I want know if they have used this before. My guess is that they have not. I don't think they can ship us this letter and require a 3rd party review. Thoughts on a pre council meeting evening.

Dan,

14 innings, a leadoff inside-the-park home run, a starting pitcher whose father had died earlier in the day, an egregious error reminiscent of the most famous in baseball history, a game-tying, bottom-of-the-ninth-inning home run, and a game that tied for the lengthiest in World Series history.
