However, erosion control is of our interest that no fill material or muddy surface water reaches the drainage way, ditches or storm inlets during construction. Silt fence and inlet protection is typically used to protect against erosion and run-off during construction activities. Regarding fill, any fill above 1-ft must be approved by a professional geotech. Grading and erosion control permits are issued at the discretion of the planning department, and in this case I would require a permit only because there is the issue of drainage onto adjacent property. I would also waive any fees for a project this small. Yet I would like to see a clear cross section of the swale, and have our engineer look at it, before I give the ok. We could meet later today but it may not be very productive without a clear set of plans. Any chance there could be more detail in the proposal, specifically in the swale? I am the property owner. So I met with the landscaper again and he appears to understand what needs to be done. Basically, what we have right now is a spout draining directly into the creek (appearing to violate the rules). He is going to work up new plans that will remove the spout draining into the creek and replace it with a swale in the south corner of the lot to keep surface water within our property lines. I will forward you the new drawing once it arrives. For now, here is a verbal description of the revised plans:

I’ve looked more into the proposal and spoken with our Public Works Director. I’ve attached a few notes she made on your drawing proposal, unofficially, of course.
The most difficult parameter to mitigate is the drainage not traveling onto the adjacent property. Indeed no water can drain onto an adjacent private lot, so the flood mitigation must happen on-site. Any type of drainage system can’t lead to anywhere, it must only help the water infiltrate the local ground. The best way to do this is to construct a type of drainage swale, trench or retention system that allows the water to percolate into the ground.
I hope to do a site visit before the short week is over to get a better idea of the constraints to this project.

Reading between the lines a bit here, but I think this idea will work as long as there is no undue burden upon the drainage-way on the railroad property.
