Also, can you please be specific about what language (i.e. Page & Paragraph) in the Franchise Agreement specifically contradicts with the City’s permit.

Jennifer – I am sorry. We had an internal communication break down on this matter and I just learned you were told I would be contacting you.
I am not up to speed on this and need to talk with legal. I have not been involved in the permit process in Molalla. As I currently understand it the language on the Molalla permits exceeds what our staff is allowed to sign. The indemnity language is such that only officers at PGE would have the authority to commit the company to those provisions. The indemnity clause exceeds the franchise and adds to PGE’s liability.
I am not an attorney, but our attorney is looking at the conflict between the Molalla permit language and the franchise agreement PGE has with the city. The franchise says that franchise language controls the terms when there is a conflict.
In the meantime, PGE folks are not allowed sign permits and we can’t get work started if it involves the ROW. I will connect with our attorney asap so we can work this out with the city and take care of our mutual customers.
