I had this email along with the attached photos sent to me Sunday afternoon by the complainant Sarah Oliver, I believe they should shed some light on the issue.

 

According to our code, all drainage ditches in private property are to be cleared of debris and vegetation. Also, discharge prohibitions would render this a violation if there was any visible sheen, toxic chemicals or the like. I believe this is something the city has the authority to enforce, but I would implore DEQ to look into this issue further.

Hi There,

 

I know you are new into the City Planners position.  I live up against the Industrial Land off Ona Way, next door to PGM Recycling (31810 Ona Way). I know it has now been annexed into the City Limits and is zoned Industrial. 

 

  I have been continously dealing with the looks of this for a few years. I have contacted DEQ in the past and they did come out and enforced changes that are short lived. Mostly regarding the number of tires allowed to be collected and the banning of open oil drums.  Recently I have taken to also collecting beer cans and bottles out of my pasture. I have also had them shooting BB guns on their lunch break into my pasture at birds in the past.  I am not too thrilled with this since I do have animals in my pasture.  I figure I would take this issue up with you, as they now have a camper with someone living inside on site.  I am sure a business in the City Limits is not within City Ordinances to permit this.  The issue of all of the open oil barrels has been addressed by DEQ in the past and they are reqjuired to be under cover which they clearly are not.  The irrigation ditch the runs into Bear Creek a block away should be free from all the metal debris and empty barrels that could/do leak potential chemicals into the waterways, not to  mention near  my well! 

 

Please let me know if this is not your area, and I will gladly contact DEQ and the County.  Due to the proximity of my well and the amount of metal and debris in the ditch I am not going to patiently wait for months before this is dealt with.  I have tried to talk to the workers over the fence and get no where so I am no moving beyond that.  I want to see if you can assist in resovlving these glaring oversites to City Ordinances, and issues regarding the unneccesarry about of machinery/debris/tires in the ditch.    Not to mention that this business last check does not have a fire hydrant near it and with the pile of tires up against the buidling is a huge fire hazard. They have bags of garbage and cat food sitting out behind a building and with them on the boarder of Rural Residential and Farm land just houses away this does provide a nusaince of stray cats, skunks and raccoons.  Lastly, what are the requirements regarding irrigaition ditches and waterways that contain water 9 months out of the year. Do busiensses have to keep stuff 10 feet back ect?

 

 

I am not the only neighbor this affects, as the oil and other chemicals have in years past been puddling onto the property in front of them as well.  I would like to see what the City Ordinances are for Businesses to adhere to. Is this posted online?   Also does the City require businesses that back to Residiential Property require fencing to block views like this?  I know the City of Canby has done a great job with fencing and privacy screens.  I can send you more pictures if you would like. I just chose to send a few since they give you a general idea regarding the condition of this business.
