As we discussed on the phone, here is the status of the Shirley well situation:

* With the assistance of Fischer's (http://www.fisherssupply.com/), the Shirley's had their well chlorinated twice but tests conducted after each chlorination have still shown non-potable water. I don't know what the exact levels of E. coli have been, but they must have been above the standard of 1 MPN/100 ml.

* Yesterday, Carrie Shirley checked the pH of their water and it was 6.4. This was below 8.0 so that means that chlorination should have killed the bacteria .

* The fact that bacteria are still present indicates a continuous source of contamination from somewhere.

* Last night, I received a call back from Floyd Sippel (http://sippelwelldrilling.com/) and we reviewed the information above, as well as information about the Shirley well (their well log, etc). He concluded that their well is "bad" and given the age of it (45 years), it would not be worth repairing it with a new seal, etc. He recommended a new well at a cost of about 8K plus 2K to decommission the old well (10K total). I asked about guarantees on new well water and there would not be any. He mentioned, however, that neighbors on both sides of the Shirley's have not had water quality problems. So, exactly where to site any new well would be an important issue.

* Trying to pinpoint the exact source of the contamination (e.g., neighbor's septic?) will cost lots of money for somebody and still not result in the Shirley's having potable water anytime soon.

Another option is to simply treat the non-potable water from the Shirley's existing well. I called Fisher's this morning and inquired about systems to kill bacteria in drinking water from a domestic well. I said that I was helping someone trouble shoot a problem but I did not mention anything about the City or the Shirley's. Fisher's estimated that the cost to purchase and install a UV system to kill bacteria for an average sized home would be about $1,500. This would include a passing test to ensure that the water is free of bacteria. The system would be installed to treat water for the whole house (kitchen, showers, laundry, etc) but it would not include any irrigation system, etc. I asked about ongoing maintenance costs for such a system and they would be:

o Pre-filter cartridge replacement: $15 each and replaced every 3 to 4 months ($45/yr)

o Annual UV bulb replacement: $140/yr

o Sleeve replacement: $60 every 2 to 3 years

So here are my thoughts for a resolution:

* Contingent on the Shirley's sign an agreement letter (read below), offer to buy and install a UV treatment system from Fisher's for the Shirley's.

* The agreement letter could be drafted by RB and include things such as:

o The City's offer to purchase and install the system in no way indicates that the City accepts responsibility for the presence of bacteria in their well.

o Nevertheless, the City recognizes the duress caused to the Shirley's by this situation and is thereby making this offer.

o After the system is installed and the water is deemed potable, the City will bear no more responsibility for evaluating or treating their water.

o Ongoing maintenance and repair costs would be the responsibility of the Shirley's.

I think this would be a fair offer to the Shirley's that they might actually accept. If everybody is in agreement, then the City could make the initial offer to the Shirley's (probably in a phone call) and if they are agreeable, then Fischer's could produce an exact quote that could be referenced in the agreement letter. I could make the initial phone call to the Shirley's if you wanted me to.

I think there is a risk in not trying to resolve this situation quickly (newspapers articles, etc). Based on my phone call with Carrie Shirley yesterday, things still seem relatively positive with them and it would be best to try and keep it that way, in my view. Please let me know you thoughts when possible.
