Hi Chris,
I think the answer is no they don’t need to reissue since date is before the bid and per (3)(b) we are required to return the bid security upon execution of the contract ORS 279B.005 (3)(c).. All in all our purposes for requiring the bid bond/security are covered.
279B.055¹
Competitive sealed bidding
(3) (a) The contracting agency may require bid security if the contracting agency determines that bid security is reasonably necessary or prudent to protect the interests of the contracting agency.
(b) The contracting agency shall return the bid security to all bidders upon the execution of the contract.
(c) The contracting agency shall retain the bid security if a bidder who is awarded a contract fails to promptly and properly execute the contract. For purposes of this paragraph, prompt and proper execution of the contract includes all action by a bidder that is necessary to form a contract in accordance with the invitation to bid, including posting performance security and submitting proof of insurance when the invitation to bid requires the submission.

Morgan, I understand the bid date has changed on this project from 1-27-16 to 1-29-16 and the EJCDC bid bond form that is being used has the bid date on the bid bond form. Our office alone has eight or so bidders on this bid & it would create quite a momentous additional cost & time consuming effort to try to reissue all eight bid bonds & get them to all of our clients before the revised bid date. Since there is such a short time frame, will it be necessary to have the bid bond reissued with the new bid date or will they be accepted with the 1-27-16 on them ? Please advise at your earliest convenience. Thank you.
