Jenn – Thanks for the feedback. It is very common to withhold retainage and it gives the City some more leverage to complete punch list items, etc. Most contractors are accustomed to seeing this requirement and I would suggest including it in the contract. The City does have the option to release it early, depending on what contractor we get.

The following is the payment schedule for mobilization in the contract. Basically, the contractor has to wait until all work is complete to get any mobilization greater than 10%. I think most contractors are used to having mobilization on a similar payment schedule and we would suggest keeping it like this.

• When 5% is earned, either 50% of the amount for mobilization or 5% of the original Contract amount, whichever is the least.

• When 10% is earned, either 100% of mobilization or 10% of the original Contract amount, whichever is the least.

• When all work is completed, amount of mobilization exceeding 10% of the original Contract amount.

Jenn and Ken – we received the comments below from a prospective bidder. My initial responses are in red. If you concur with my responses then we can issue an addendum to clarify.

Ken – I would like to include a new completion date for NW Natural in the addendum as well. Can you confirm when they will be able to complete their relocations?

1. Please confirm the Substantial Completion Date of Nov 30th, 2016 in the

Agreement. The proposal Section calls for 80 Days on Page 14.

Completion date is Nov 30th, 2016. We will plan to update the Bid Proposal section to list the Nov 30th, 2016 by an addendum.

2. Clarify Article (5) of the Agreement. I do not think the retentions are listed

properly. There are typos regarding the progress payments at 100%??

It appears that all of these should be 95% (i.e. 5% retainage). Jenn, can you confirm that the City typically holds 5% retainage? If so, we will update this section by an addendum. We elected to not hold the retainage the last contract. I don’t see an issue with doing that again. I would rather see us hold 5% of mob until the project is complete and the contractor has de-mobilized. Do you know if the specifications allows us the ability to pay this as a percentage until the contract is complete?

3. Prevailing Wage Section calls for July 2015 Rates? Project advertised on 1/6/16.

Normally the January 2016 advertised date would call for January 2016 rates. Please clarify

the rates to be used.

It appears that the July 2015 reference is a holdover from when we anticipated bidding in 2015. We will plan to update this reference to January 2016 by an addendum.
