After checking internally, please let me know how quickly you and your team could get both the spill response plan and the checklist done. As I mentioned, the settlement agreement expressly requires those things to be in place upon execution and we absolutely don’t want to put the City in the position of violating that agreement right out of the gates.

Bill- To further follow up on our call, the settlement agreement contains this provision:

Prior to commencement of the 2015 irrigation season, the City shall develop a compliance checklist covering the requirements of the RWUP for distribution to the irrigators to whom recycled water is distributed. Upon completion of the irrigation compliance checklist, the City shall provide a copy to Plaintiffs.

I looked at the final approved RWUP and the only checklist I see is Appendix L (Irrigation System Inspection Checklist). Is that what you were referring to when we spoke?

Yes

This is a different type of checklist than that contemplated in the settlement agreement. That checklist is mean to cover all compliance issues. Are you aware that anything like that has been provided to the site owners?

No, not yet.

If not, that is another task that we need to complete right away so that the City will be in a position to sign the settlement. Please let us know your thoughts on this.

BC’s current scope of services includes development of checklists for N. and S. Coleman, but not the other sites (Cemetery, etc). The checklists for Coleman Ranch are not yet done because things became sidetracked after the spill. I will need to work on the checklists too. I’m also trying to find internal help for the emergency response plan.
