My thought is that we proceed as we do currently. That way if there is excessive litter or damage the City can charge for the clean-up and repairs as need. Which is what we have been historically doing without necessarily charging for it.

We would need to define on the permit what is excess littering or damages, state the hourly rate that will be charged (rounded up to the nearest half hour) and high-light it. At least then it cannot be argued what is considered excessive. I am willing to make the changes if someone emails me an electronic copy of the permit.

Sorry for the delay….I wanted to bounce this off CIS before I answered you (see below). The $25 only applies to community gardens. If you charge anything at a park, the rec immunity is gone. That’s not necessarily bad…you just need to weigh the “risk/reward” of it. Will you generate enough revenue to take on that additional risk?

We are looking at charging fees to use the parks. I know after $25 we lose our recreational immunity with then garden but other cities have implemented fees for park usage so how do we protect ourselves while doing so without making a family of 4 produce a COL for a million?
