The second paragraph states “treatment” not specific if it is “in-patient” or “out-patient” only that it is provided by or by referral of a health care provider. I believe he’s okay as long as the treatment is provided or referred.

We still need to the FMLA paperwork to determine if its psychiatric or substance abuse.

FMLA does not cover substance abuse outpatient treatment – I don’t think. We need to do some research into this.

I got ahold of the Release of Information Office at Kaiser regarding the FMLA. Apparently it takes 5 to 7 business days to process the paperwork. They told me they would be mailing it to me today. Once I have it I'll get it to you. I'm not sure about the outpatient FMLA details, I'm not sure if it is different depending on employer. If you could send me the info that would be great.
