For example, you reroute the water line and no longer use that location for waterline purposes then it reverts back to the property owner and there is no more easement. If that were the case, then you would likely go ahead and vacate the easement anyway but this clause covers that in case the paperwork isn't followed through with and recorded. There are only one thing that I had a question about. How many months do you want in item 6 of the agreement. I recommend 12 months. I have easement documents that we can set up, at a later date of course, and you can make those your standard documents if needed. That way developers only have to come up with the exhibit map and legal description then sign the pre –approved City easement document.
