Hi Jennifer-

Thanks for sending me an email with your contact information. Below is a summary of DEQ’s beneficial use requirements as it relates to asphalt.

Chunks of weathered asphalt that have not been ground up are defined as cleanfill in DEQ rules.

Asphalt grindings that are fine and unconsolidated are not cleanfill.

DEQ’s beneficial use rules have a standing beneficial use for asphalt pavement or grindings in OAR 340-0930-270(5).

(a) Asphalt pavement or asphalt grindings from road projects

 

As asphalt and aggregate in new asphalt pavement or as fill within road prisms

 

Asphalt grindings must be compacted when used within road prisms

 

 

 

    

If someone wants to use asphalt grindings as a roadway or in a parking lot, DEQ requires that the material be rolled or compacted so it consolidates so the fine particles cannot runoff into waterways.

If someone wants to use it in another manner than identified in the beneficial use rules, that person could consider applying for a solid waste letter authorization or case specific beneficial use request.
