Dan,

It appears to me under sections 4 and 5 of the agreement MCC is responsible for the cost of the work, including reimbursement of the chipping out of concrete. They were notified at the time when the lines were discovered. Do you want to notify Gary at MCC first that they are responsible? Also, their lines are currently exposed and need to be reincapsulated in concrete. I will need to verify if MCC wants to do the work to save on cost.
