I will need a day or so to make field measurement on the driveways. This may be hard to determine what or if any driveway impacts had the curb been placed at the existing road elevation. Or we could leave that part out and just go after a portion of the following:
(1) the $109,215.00 gross estimation adding error of the Paving & Surfacing quantities in original C-M engineers estimate.
(2) the unplanned Subgrade Stabilization quantities in excess of 811.4 cy – 50 cy = 761.4 c.y. (93.4% increase) at $62/c.y. (the renegotiated cost) totaling $47206.80 and
(3) the missed shallow concrete storm line on Stowers (north of 5th St.) that need to be removed and replace with 10” ductile iron and totaled $7065.00 for 161 LF @ $47.10/LF. This storm line elevation was clearly identifiable in the field by removing grates and survey the inlet elevations in the field.
Without measuring the added impacts to the driveways due to the increased design cross-slope of the road section on Stowers, I come up with the following total of unanticipated construction costs due to lack of attention to detail and geotechnical exploration:
Total = 109,215.00 + 47206.80 + 7065.00 = $163,486.80
One could easily argue that C-M is responsible for 50% of the added costs to construct, due to lack of attention to detail in the estimate and to gather adequate field information in 30% design phase. Had this information been presented to the City accurately, the City could have make the decision to postponed the construction of Stowers to FY 2015-16.

I have warned Chad Jacobs and once I provide them him with our details I want to obtain a reimbursement from Curran-McLeod.
