I agree with Gerald’s comments. 

As for the Street sign, this sign will be labeled as a “private drive”.  The developer will need to reimbursed the City for the purchase and installation.  Once installed, this sign will not be maintained by the City.

Nicolas,

The way I read it is that the turnaround will be required and this will be the last partition allowed since the frontage home also uses it as one of their accesses.

19.12.040.C. Flag Lots. Flag lots may be created only when a through street or mid-block lanes cannot be extended to serve abutting uses or future development. A flag lot driveway (“flag pole”) may serve no more than 2 dwelling units, including accessory dwellings and dwellings on individual lots, unless Uniform Fire Code (UFC) standards are met for more units. When UFC standards are met, the maximum number of dwellings shall be 4. A drive serving more than 1 lot shall have a reciprocal access and maintenance easement recorded for all lots. No fence, structure or other obstacle shall be placed within the drive area. The Fire Marshal may require an emergency turn-around. Fire sprinklers may also be required for buildings that cannot be fully served by fire hydrants (i.e., due to distance from hydrant or insufficient fire flow).

My other comments are as follows:

1. Agree with Jen’s concerns about water and sewer service separation.

2. Frontage improvements across Parcel 4 and the flag lot driveway should be required. This includes concrete driveway and curb tight sidewalk.

3. The reciprocal easement needs to remain and include the new lot into the mix.

Jen – Please find attached conditions of approval for your review and revision. Once done, please have Nicolas incorporate all of your conditions into the final decision. Thanks.

Is this to be a single home, duplex or other? Anything other than a single family home of 3,600 square feet or less will need to contact Molalla fire as hydrants are severely over spaced in this area and additional hydrant(s) will be required based on required fire flow for the project. There is currently no dedicated area for a turn-a-round anywhere on rivers lane. Please have the property owner/builder provide Molalla fire with length of the access road with measurements starting where the edge of the road stops on Toliver and rivers lane begin and should end at the middle of the driveway. This will make I believe the 4th or 5th home off of rivers lane. I would like to see a “real” road sign with reflective letters that matches the rest of the City of Molalla signage. Also. There was a neighbor dispute between 913 Toliver and 660 rivers lane about 3 years ago. The result in this dispute was a fence being constructed down the middle of rivers lane. So with new construction, nothing should be allowed to be constructed or planted that would further hinder access to the rest of the properties. Addressing shall meet the requirements of Section 505 of the Oregon Fire Code.

Hi Nicolas,

My biggest concern is utilities. A separate 4” min sewer lateral and water service must be placed in easement to service the Parcel 5 home. If the current Parcels 2 & 3 already have Utilities (including gas, power, sewer and water) in the 20-ft easement, I don’t see how there will be room for another home. I recommend the new Parcel 4 provide a new utility easement for Parcel 5.

I’ve included a clearer copy of the 1997 partition.

Looking for any comments you may have for the attached partition proposal located at 917 Toliver Rd (TL # 52E08BB01400). A final decision shall be rendered following May 3, 2016. If you could provide any comments before then, it would be appreciated.

 

I attached a plat as well which illustrates a legal access from what is called Rivers Lane, a 20’ wide access.

 

Toliver on the north side is improved minus sidewalks. I attached a screen grab of the streetview for reference. Access to newly created parcel looks to be 140’ long, roughly.

Let me know if you have any questions, or would like to discuss particulars between now and May 3rd.
