I think we’re hitting the same problem we keep finding… everywhere. There was a permanent 15ft easement on the construction plans but the County doesn’t have a record of it.

I would have to go to the County and check their documents to 100% confirm. Worth it?

Hi Dan,

There is a property for sale that has a portion of the Bear Creek trunk line running through the NE corner. Do you know or can you verify with the county if a public utility easement has already been recorded for City to maintain this by-pass. I don’t see is coming up on the County’s plan map, and not sure how the City constructed the by-pass without an easement from the property owner?

Another awesome point. One of the main trunk lines, Bear Creek Bypass runs through the corner of their property. In which, we need an easement from the property owner. Probably before it sells.

Yes and no. It’s a residential use on an industrial property, requiring them to hook up to city services at this time could be construed as ‘furthering’ a non-conforming use and would be against our best interest and theirs.
