Hi Ian,

The City is not requesting to waive the fee, rather we are asking refund the first fee and reissue the permit under the renewal fee given that construction had not begun. Is that a possibility?

Recently, we had a similar issue arise with Water Resources and had they ability to refund the permit.

Thank you for the information. We prepared a new application and the City of Molalla sent the packet to DEQ last Friday; perhaps your office has received it by now. We would like to make sure that you have everything you need to review the application. The City has a contractor ready to commence construction so the permit is a bit of a time sensitive issue for the project. Please let us know if you need anything from us.

Hi Ian,

This is a follow-up to my phone message. Thank you for letting us know about the permit status. It’s unfortunate news for the project, but the positive news is that construction has not yet begun. The City of Molalla does have a contractor on board, and we will likely prepare the new permit application with the contractor as applicant.

As I mentioned in my phone message we have a couple of questions:

1. As circumstances expired the original permit only 19 days after issuance, would DEQ consider waiving the application fee for the new application? The original fee of $1725.00 paid by the City of Molalla for 19 days of coverage is a lot for a relatively small community to bear. Or, maybe pay the $207.00 difference between last year’s and this year’s application fee?

2. What is the DEQ address to re-submit the 1200-C application?

Randal,

I just received your application for renewal of 1200-C permit coverage for the Molalla Avenue Improvements project. Unfortunately, the renewal period ended last year and this permit registration expired November 30, 2015. Currently, there is no active 1200-C permit registration for this project. If this project is active it is currently operating without 1200-C permit coverage, which would be a violation of Oregon environmental law. In order to regain permit coverage you will need to submit a new application, including the application form, the land use compatibility statement and any attached findings, erosion and sediment control plans, and the fee of $1932.
