Jenn,

We received this letter just now from ML Houck regarding the existing water line conflicts with 30 inch storm. It appears they want extra money for the conflicts at 2nd, 3rd and Ross (they didn’t mention Robbins). I would like to discuss this with you before we respond. A few things to note:

· They are claiming that they are following the contract sequencing. It is true our Traffic Control Plans show Stage 1 as the east side and Stage 2 as the west side; however, Traffic Control Note 7 states that the “traffic control plan is conceptual in nature and is not intended to be complete in design.” Our plans show the final installation and ultimately we don’t dictate their means, methods and sequencing.

· Similarly, RFI #5 is intended to show the final configuration. The only change from the final configuration is that we can likely remove the horz bends at 2nd, 3rd and Robbins. We have viewed the temporary connections as the Contractor’s means and methods.

· RFI#5 didn’t address the conflict at 3rd. To date we haven’t received notice that there is a conflict here.

· General Note 5 on Sheet G-2, does say that no additional payment shall made for utility relocation coordination or delays caused by utility conflicts.

· That all said, the storm profile does not show the existing water line, so Houck could claim that they couldn’t anticipate a conflict there. Depending on how you would like to address this, I could see paying them to temporarily cap the existing line and any additional pipe removal not already identified on the plans.

In general, my understanding from our meetings was that Houck had a plan to address each one of these conflicts, so I am a bit surprised to hear that they are waiting for direction. I will give you a call this afternoon to discuss. Thanks!
