Below is Ordinance 2016-01 and Ordinance 2016-01A, implementing changes to the existing Molalla Municipal Code.

The first ordinance has been approved by Council, the second ordinance is in process of approval due to a clerical error.

Additionally, it is the City’s understanding there is a “sag” in the building sewer or “lateral” line in the street section. This would not be considered in failure and requiring repairs, unless the line has failed to function. It is also the City’s understanding that the line has been functioning properly with no issues since the home was constructed, as indicated by the home owner on Monday 2/21/2016 at the counter in City Hall.

13.08 Article 1

CHANGE 13.08.040 Building Sewer:

From: “Building sewer” means the extension from the building drain to the public sewer or other place of disposal. (Ord. 2007-07 §1; Ord. 1976-2 Art. 1 §3)

To: “Building sewer” means the extension from the building drain, including the connection, to the public sewer or other place of disposal.

13.08 Article 5

REPEAL 13.08.570 Special Agreements

ADD 13.08.580 Reporting of Harmful Discharges: Businesses are required to accurately report chemical discharges to

the sewerage system and other discharges that may affect the sewerage system as directed by the Public

Works Director via survey Or other means as pre-approved by the City Manager or designee.

13.08 Article 9

CHANGE 13.08.660 Violation - Penalty:

From: Any person who continues any violation beyond the time limit provided for in Section 13.08.650 shall be guilty of a violation and, on conviction thereof, shall be fined in the amount not exceeding $500.00 for each violation. Each day in which any such violation continues shall be deemed a separate offense. (Ord. 2007-07 §1; Ord. 1976-2 Art. 9 §2)

To: Any person who continues any violation beyond the time limit provided for in Section 13.08.650 shall be guilty of a violation and, on conviction thereof, shall be fined in the amount not exceeding set by Council

resolution for each violation. Each day in which any such violation continues shall be deemed a separate offense. Failure to comply with a written directive or timeline of the Public Works Director made under the authority of this chapter is a punishable offense and may result in a temporary loss of City water and sewer services.

CHANGE 13.08.690 Responsibility:

From: The owner of all houses, buildings or properties used for human occupancy, employment, recreation or other purposes, situated within the City, wherein such facilities are connected to the proper public sewer in accordance with Articles I through IX, are responsible for the maintenance and cost of maintaining the private service lateral within their private property. (Ord. 2007-07 §1; Ord. 1983-1 §2)

To: The owner of all houses, buildings or properties used for human occupancy, employment, recreation or other purposes, situated within the City, wherein such facilities are connected to the proper public sewer in accordance with Articles I through IX, are responsible for the maintenance and cost of maintaining the private building sewer (lateral) and the connection to the city main.
