I am passing this along to you in case you want to forward the following information and message to CIS that Miss Parham has contacted the City again. I previously told Parham the City was not working in that location and that EE may have been working in the location at that time. However after speaking to Eagle-Elsner’s (EE) insurance representative last week, it was evident that EE had completed their work prior to her accident.
The agent stated Eagle-Elsner was not working there at the time Carol slipped and fell on gravel. Eagle-Elsner shows their last day of work on May 17th in the City, and I agree since I have documentation that EE requested Substantial Completion on May 1st. Her accident happened after the May 17th date.
Parham claims that she fell on the NE corner of the intersection. The City and/or EE had completed work and clean up at that NE corner location weeks prior to the time she fell. I suggest she contact the other utilities in the area; MCC, NWN, PGE or Wave to see if they happen to be doing work in that area at that time of her accident.
It is my understanding that CIS had made her an offer out of good faith, and Parham denied the offer because it was not large enough. She was not working before the fall and insists that the City pay her loss wages for a job she has never had.
