After looking at the tree I don’t see an impending hazard presented by this tree. It’s root system isn’t close enough to the home to threaten the foundation, and it poses no immediate threat for falling either. Personally I recommend leaving it alone. However, if you so desire, here are your options:

 

- leave the tree as is

- provide a written statement including photographic evidence as testimony for the hazard that the tree presents, and provide assurances for the planting of a new tree pursuant to the following code standards for Street Trees: http://www.qcode.us/codes/molalla/view.php?topic=18-18_08-18_08_040&frames=off

Let me know how you would like to proceed. Again, I don’t believe replacing the tree would accomplish anything as the new tree would go in almost the same place as the existing tree in order to meet spacing standards, and potentially even closer to the home as it looks like there’s a 10’ PUE on your property (plat attached as well).
