DEQ has determined that rolling out ground asphalt as a compacted parking surface (specifically in the case of the property located at 1212 Toliver Rd in Molalla which will accept approximately 1,600 yards of material over one acre of area – Excavated from Hwy 2013 by Kerr Construction under contract with ODOT) fits the intent of the Standing Beneficial Use for asphalt in OAR 340-093-0270(5)(a). This determination does not exempt the property from being managed to comply with other State or local regulations or restrictions on land use.
