To whom it may concern,
If you have already submitted your 1200-C renewal application, notice of termination, or have transferred coverage please disregard this email. You may check the status of your application here.
Our records indicate that your construction project is currently covered under a National Pollutant Discharge Elimination System 1200-C General Stormwater Permit. Please note that this permit will expire on November 30, 2015. On or near the expiration date, DEQ will renew the permit and all active construction projects will need to meet the requirements of the renewed permit.
You must take the following action that is applicable to your situation to avoid unnecessary permit fees and violations of state law.
If your construction project will continue beyond November 30, 2015:
· Submit the enclosed Renewal Application form to DEQ, Ian Garner, Water Quality Permit Coordinator, 700 Lloyd Building at 700 NE Multnomah St., Suite #600, Portland, OR 97232
There is no fee for this renewal action. However, DEQ may refuse to renew coverage if there are outstanding invoices (Annual Compliance Determination Fees) for this project. If you have, questions regarding invoicing contact Rod Lemeni, DEQ Water Quality Division, at (503) 229-5437.
If you are no longer involved with this construction project:
· Fill out Section A, B, and E of the Name Change/Transfer Form (enclosed) and provide it to the new owner/operator. At the same time, to help ensure the transfer is successful, also send a copy of this form to Ian Garner, Water Quality Permit Coordinator 700 Lloyd Building at 700 NE Multnomah St., Suite #600, Portland, OR 97232
Note that the form will require your signature, the signature of the new owner or operator, and a transfer fee of $84. You will be responsible for paying the annual permit fee of $875 if the permit is not promptly transferred to the new owner or operator and the new owner/operator will be in violation of Oregon Law for failure to obtain permit coverage if they continue construction at the site.
If your construction project has been completed:
· Final site stabilization measures must be in place and you must submit a Notice of Termination form (enclosed) and photos of the site to DEQ. Attn: Ian Garner, Water Quality Permit Coordinator 700 Lloyd Building at 700 NE Multnomah St., Suite #600, Portland, OR 97232
If you do not formally terminate permit coverage by submitting the Notice of Termination form, you will be responsible for paying the annual permit fee of $875.
If you fail to submit the renewal application, you will have to reapply for coverage under the renewed permit and pay the application fee. Please note that if you do not submit a renewal application before the permit expires, you cannot continue with construction until coverage under the renewed permit is granted by DEQ or DEQ’s Agent.
If your construction project will end before November 30, 2015:
· You are not required to submit a renewal application; however, final site stabilization measures must be in place and you must submit a Notice of Termination form (enclosed) to DEQ, Attn: Ian Garner, Water Quality Permit Coordinator 700 Lloyd Building at 700 NE Multnomah St., Suite #600, Portland, OR 97232 to terminate permit coverage.
Carefully consider terminating permit coverage because once the current permit has expired, you must reapply for the renewed permit at a cost of $1725, and you must discontinue all construction until new permit coverage is received.
Please note that you are responsible for maintaining compliance with the 1200-C permit conditions at all times. A copy of the 1200-C permit and related materials are available online at http://www.deq.state.or.us/wq/stormwater/constappl.htm.
If you are currently out of compliance with any of the permit terms, you must take action immediately to avoid potential enforcement action. For example, if you have updated your Erosion and Sediment Control Plan, you must submit that update to DEQ, Ian Garner, Water Quality Permit Coordinator 700 Lloyd Building at 700 NE Multnomah St., Suite #600, Portland, OR 97232. If your Erosion and Sediment Control Plan has failed to prevent sediment from leaving the site, you must update it and submit it in the form of an Action Plan. It is not necessary to resubmit these materials at this time if they have already been submitted.
When the permit renewal is completed later this year, DEQ will notify you of any new requirements. If you would like to track and/or participate in the permit renewal process, you can sign up for e-mail updates on the DEQ web site at http://www.deq.state.or.us/wq/stormwater/stormwater.htm by clicking on the “Sign up to receive e-mail alerts on stormwater” icon near the top left corner.
Due to the large number of renewal applications being processed, DEQ will not be sending you a letter to confirm that your application has been received. You may check the status of your renewal application at http://www.deq.state.or.us/permittracker/.
