Gerald - I believe it has been repealed

Hi Angela,

Is there any chance that the repealed Silverton code linked above contained language specific to blowing leaves into the street? I am not finding any such language in the current code and we are looking to adopt similar language in Molalla.

The section in question is: Chapter 12.36 TREES, SHRUBS AND PLANTS (Repealed by Ord. 06-03)

Silverton has a good code language specific to blowing leaves into the street. Please look up when you have a moment and send to me. I think it might be in the street section of the code.

Darren – yes, that’s the best one. Thank you. I was remembering Chapter 10 but couldn’t figure the right headings to follow.

10.28.020 Obstructing streets.

Except as provided by this title or any other ordinance of the City, no person shall place, park, deposit, or leave upon any street or other public way, sidewalk, or curb any article or thing or material which in any way prevents, interrupts, or obstructs the free passage of pedestrian or vehicular traffic, or obstructs a driver’s view of traffic or official traffic signs and signals. (Ord. 517 §45, 1970)

Darren and I talked about this a few years back and I think there are a couple pieces of code that kind of apply but not specifically to leaves.

8.10.010 Abutting property owner’s duties regarding street trees.

12.32.020 Obstruction permit—Required.

Are the ones I can find that are closest. Darren, does this sound right?

Dan, can you help me find the Code Section that prevents people from blowing leaves and yard debris into the street for the sweeper to pick up?

Darren, assuming this code section exists: if you see them doing this please stop the machine and take a picture of them doing it (this alone will stop the behavior). Forward the picture and address to me and Dan Z, we will address it with code enforcement. It’s okay if this takes extra time at first, they will learn quickly. If the problem persists we will revisit with additional tactics.

Andy,

Are we able to add something to the cities FB page notifying residents of tree height requirements over city streets and sidewalks (14’ over streets/8’ over sidewalks.) This is becoming more of an issue as the heavy sweeping time of year is upon us.

Also – Can we add something that lets people know it is a violation of city ordinance to blow, rake etc. their leaves into the public right of way. I am having people regularly see me coming and start putting materials in the roadway for me to sweep up. Although some cities allow for this, my understanding is we aren’t one of them.
