O.K. Now I am always in for being a team player and agree that we have a benefit and a responsibility here. I will only sign an easement agreement if we are not responsible for a monthly cost. So we need to quantify and actual $ amount or specific maintenance responsibility. Maybe you can check with Mr. Sauvageau on that. And I am wondering why we do not have a separate easement with Weyerhaesuer. Not sure I am comfortable with all those other names on the easement.

Also, something to keep in your back pocket….because we are a public utility providing water to a community, Weyerhaeuser can actually never keep us from accessing the plant, even if they threaten.

This is the access gate crossing MFR on the way up to the WTP. Outside City Limits. Historically, the gate maintenance (existing gate- not electric operated, but manual open), gravel access road maintenance , and tree trimming and brush clearing are shared by an unofficial LID. The group of folks that live out there each pay a share to Weyerhaeuser in maintaining access to their properties.

Our WTP access is utilized from this roadway as well. The group has approached the city in the past to inquire as to what , if any money, materials , or otherwise contributions we would make for the work that gets accomplished out there. Past CM’s all handled this differently with Weyerhaueser. Atkins would give away the farm, Barnes- nothing.

They usually ask for a money contribution, although since I’ve been here, we haven’t given them money. We have donated rock, in the past , and our dump trucks and labor for some grading , roadway work out there because we – the city need access through this roadway as well. About once every two years we might donate 10 or 15 tons of rocks.

That’s 3 or 4 dump trucks to help this cause. Their latest venture, is the electric gate install. About 18 months ago , they approached the city and wanted a monetary donation.

Barnes said no, they pushed for a meeting, they called me in for the meeting. They wanted something, the city initially shut it down, and then instead of everyone walking away pissed off, I suggested we help in the way of a material procurement for the gate when they are ready to build. No money exchange , but a piece of their gate funded from the city as a contribution , as we do like the other components for maintenance out there.

Why do we do this?

We need access through the gate. If the city contributes nothing, Weyerhauser reserves the legal right to not let us access through their roadway . And we won’t be able to get a remote to let us through the new gate.

They’ve mentioned this to us in past meetings. Not to threaten , but to remind the city on who owns the access. No , we don’t have any current easements that are city derived or recorded.

To get the gate automated Weyerhaeuser is requiring all land owners sign an easement for the power. I will be placing the power from the RC Airpark to the gate. I was told by the city of Molalla they can't pay a percentage and will be buying an "item" (electric eye or keypad etc.) of the same value due to accounting issues. I have spoken to Dale Robinson and he and myself will be the point of contact for issues as stated in the easement requirements.

Any new houses built or landowner(s) wanting a gate remote will be charged a percentage just as we all have. Those funds will go into a maintenance account. Currently each remote will be $29 according to the gate company. A $20 yearly charge per land owner should cover power costs. I will be handling the monthly power bills and the collections of money at least for the first year.
