Please see attached map. ODOT has OK’d the installation of the stop sign. Use telspar pole and base. This will all go away in the future when a roundabout is built at this location per the TSP. Thanks.

Hi Jay,

Your request for a Stop sign at the western access for the Astro Express Mart & Deli to OR 211 was forwarded to Region 1 Traffic for consideration. Unfortunately, you were misinformed and ODOT does not have the authority to install traffic control devices for accesses along a state highway belonging to private property owners.

It is illegal to pull onto a main roadway from any access without yielding to traffic per Oregon Revised Statute (ORS) 811.280. This is a citable offense that does not require the installation of a traffic control device.

811.280 Failure of driver entering roadway to yield right of way; penalty.

(1) A person commits the offense of failure of a driver entering a roadway to yield the right of way if the person:

(a) Is operating a vehicle that is about to enter or cross a roadway from any private road, driveway, alley or place other than another roadway; and

(b) Does not yield the right of way to any vehicle approaching on the roadway to be entered or crossed so closely as to constitute an immediate hazard.

(2) This section does not apply where the movement of traffic is otherwise directed by a traffic control device or a driver of a funeral escort vehicle.

(3) The offense described in this section, failure of driver entering roadway to yield right of way, is a Class B traffic violation. [1983 c.338 §612; 1991 c.482 §14; 1995 c.383 §54]

I have contacted the City of Molalla Public Works Office and discussed the situation. With no objection from ODOT Region 1, the City of Molalla has agreed to move forward with a Stop sign installation at this location to reinforce the legal obligation of drivers to come to a full stop before entering onto the highway.

Jay’s concern is the traffic leaving the Astro Gas/Mart and Apartment complex are not stopping or yielding before entering OR211 – in either direction. Jay has had conversations with the local law enforcement (no signage to stop) and the city (private home/business). Both agencies referred Jay to ODOT. Jay’s concern is the safety of those to pull out in front of traffic and create crashes – or near crashes.

Jay is proposing stop signage before entering OR 211 from the north side, just as there is from the south. Actually, his suggestion is “Stop and yield to all traffic.” I told him I wasn’t sure that was an option in the MUTCD and I’d send his suggestion to staff to consider.
