Hi Andy,

The only thing I would add to the Dan version is that the property owners or HOA will need to hire a firm specializing in this type of work to perform the maintenance and submit a report on their behalf. That work can be performed by landscaping or environmental companies who have experience with these systems.

The reason I say that is that the property owner who doesn’t know what to do will just weed-wack and spray herbicide as a way to manage the pond then wont know why we send them a violation notice.

Gerald, I came up with “5 rules for writing letters like Dan”. Then I drafted this response to that real estate agent that was asking about your Stormwater Maintenance Agreements yesterday. First I did it my way, then tried to sound like Dan H. So the second version is the one I will send. Does this response work for you?

Good Morning Ms Boianoff,

I spoke with the Public Works Director on this issue. This stormwater maintenance agreement is a standard agreement throughout the City for homeowners that have privately own storm systems like the one at 220 Hezzie Ln. The reason for the agreement is that although it’s privately owned, a malfunctioning or poorly maintained storm system affects the whole community downstream, just like any other storm system in town. Since the City will not be maintaining these private facilities the agreement is in place to ensure the owner of keeps it in good repair. The Standards for storm swale installation and maintenance are specified in the Public Works Standards, beginning in section 3.6.6. Here is a link to the standards.

At this time the City is just expecting responsible parties to send a letter once per year as specified in the agreement documenting the work, if any, that was done to keep the storm facility functioning properly. Although the agreement asks for the letter to be sent to 117 N. Molalla Ave, I believe the post office will expect it to go to the proper PO box:

Thanks for Contacting the City. This stormwater maintenance agreement you refer to in your email is a standard agreement for property owners that maintain privately own storm systems in Molalla. Unmaintained Storm Systems affect everyone, so this is a way for our community to ensure property owner keeps their private systems in good repair. The maintenance requirements can be found in the Public Works Standards (Link below) beginning in section 3.6.6. You can help your buyers by reminding them to send this letter once per year documenting any maintenance performed, as specified in the agreement. The City has a PO box:
