Hi Roger,

During construction of the project along Molalla Avenue, we were approached by the property owner and provided him with an option to install a new sewer service to the property before the roadway project was completed as long as he covered the costs for the additional lateral work (MMC 13.08.390). We informed him that once the roadway was completed, a 5-year moratorium (Public Works Standards 2.2.34.c) for pavement cutting would be in place and that no pavement cutting is allowed unless there is a documented emergency such as a gas leak or other failure of the system. We also informed him that double connections to service laterals are not allowed (MMC 13.08.400). The moratorium is in place to protect the investment the community put in place because once you cut the pavement you effectively cut the life of the pavement in half.

At this time and until the moratorium is lifted, no permits will be issued for pavement cutting of Molalla Avenue. Your clients options are 1) to wait until the end of the moratorium, or 2) secure a private easement across the property to the west of that location and install a service lateral to the sewer line in Metzler Avenue.

I am trying to sell this vacant commercial lot but am told there is 4 years remaining on a Moratorium to connect water and sewer.

Does that mean that it cannot be done at all, or does it mean that an extra fee will be charged? If it is an extra fee I need to know how much it is so I can be transparent to any prospective buyers.

Please reply with information for me to share with a prospective buyer.
