Mr. Ferrell – This particular issue is long since overdue based on the original conditions of approval for Molalla River Estates and is basically a compliance issue that needs to be resolved. The easy way to complete this process today is to have the current owners deed the property to the City. We have completed this paperwork. There is zero value to the City of Molalla regarding taking over this property other than maintaining a lift station and storm drainage detention basin for city residents. There is no property value and Clackamas County has assumed so – hence the $0 value emulating public property.

The City of Molalla is a public agency and must conduct business in a certain way and attorney(s) are required in order to make that happen. If you would like to maintain ownership in your name the City will notify the Oregon Department of Environmental Quality (DEQ) as well as the residents of the subdivision that the lift station and storm drain detention basin is your responsibility. You may find the power bills, maintenance requirements and DEQ permit fees costly. The City will not agree to sign a document indicating a $150,000 value to a piece of property that has no value that should have been deeded or turned over to the HOA 13 years ago. Please work with Nicolas Lennartz to complete this process amicably.

Hi Nicolas,

This again is Linda’s husband. For the last time, please don’t contact my wife concerning this subject.

There is no need to contact a lawyer to transfer property. It costs about $59.00 at the county office. I was there yesterday and of course the assessed value is listed as being zero or there would be an annual tax due. However, my CPA requires a statement from the city stating that the initial construction costs be listed on the transfer of title of $150,000 before and signatures should be completed.

As you and I know, I don’t have to do this. I am simply attempting to do the right thing for The City.
