Attachments: message.wav; Hi Dan, Please have a listen to this voice message. Drainage for 5th street has always gone from north to south to Bear Creek. As part of Oregon Drainage Law they are required to continue to convey flows across their property and we don’t need an easement. I checked with Sadie and Heather and they are not aware of any written agreement absolving the property owner of stormwater fees. There are no exemptions to the stormwater utility fee or in the fee methodology. The fee also has nothing to do with their property as it is their fair share of contribution, with the rest of the community, for the maintenance and operation of the storm system City wide. The fee is based on their impervious surface which includes gravel areas because the compacted gravel does not drain like landscaped areas. Please let me know if you are going to call him back or would like me to do it. My answer will be they have to pay the fee unless there is a written agreement and we can confirm that the written agreement is not in violation of our City code. Thanks.
