I knew all of that but your "15 days" canned message is not clear as far as I am concerned. Maybe you would be better off just quoting the law.

Yes, that is correct. The timeframe outlined in SB 481 is:

· Within five business days from the date we receive the request, we are required to send the acknowledgement (Section 2, a-c).

· Within ten business days from the date we were required (not the date we sent the acknowledgement) to send the acknowledgement, the request must be completed, or the requester must be sent a statement that we are still processing the request and a reasonable estimated date that we expect to complete the request. This is found in SB 481, Section 4, (5).

When looking at the timeframes combined, we have 15 business days from the date the request was received to:

· complete the request, or

· contact the requester with a statement that we are still processing the request and a reasonable estimated date that we expect to complete the request.

I hope this clarifies the timeframe.

Thank you,

Dana

The message I responded to did not say FIVE WORKING DAYS but said this - 15 days to respond:

Thank you for your public record request. DEQ is currently working to

> determine whether we are in possession of the records you requested and

> will follow up with you as soon as possible, but in no case later than 15

> business days after receiving your request.

Hopefully your message in response now reflects the new FIVE DAY to acknowledge requests instead of the 15 day message I complained about?

DEQ public records dept.,

You now have to respond whether or not you have records responsive in five working days, instead of the 15 noted below in your return message. Perhaps this message should be changed since it is no longer correct?
