DEQ explained the process for the amendment of the Recycled Water Plan to the city. IT is like the amendment of a permit—it involves DEQ review and approval before it can put on public notice. Once on public notice, public comment is taken and must be considered and responded to. At this time, we’ve received the plan and it is being reviewed. We have not “signed off’ on the plan at this time. Attached is an email that documents wat we communicated in writing about the plan amendment process and some follow up questions from the city. DEQ was furnished with Molalla's "path to compliance" on the City's website that alleges it is certain to amend its recycled water plan and now I wish you to note this from the March 14th Molalla City Council minutes (attached): "Mayor Thompson asks the status of the recycled use plan, Fisher explains it has been turned into DEQ after their review they will turn it over to Oregon Health. There will be a public comment period of approximately 45 days and then City will meet with DEQ and complete any issues there may be, get it approved, and ready for this year’s irrigation season." (bold added). Has DEQ told the City of Molalla that it is a sure thing that there will be APPROVAL for the amended recycled use plan? It was the understanding of Bear Creek Recovery that there is a PROCESS and that DEQ is not supposed to be making deals behind closed doors regarding advance approval of any permit changes? Why is Molalla's Public Works Director Fisher noting "approval" at this time - has DEQ in any way signed off on this amended plan or told Molalla approval was certain?
